Not until the 1960s did courts begin to use the Fourteenth Amendment to impose a concept of equality that the authors of the Declaration of Independence, the Constitution, the Bill of Rights, The Federalist Papers, and the Gettysburg Address never believed in. Before the 1960s, equality meant every citizen enjoyed the same constitutional rights and the equal protection of existing laws. Nothing in the Constitution or federal law mandated social, racial, or gender equality.

There are those, on the one hand, who hope to achieve the social revolution through the State by preserving and even extending most of its powers to be used for the revolution. And there are those like ourselves who see the State, both in its present form, in its very essence, and in whatever guise it might appear, an obstacle to the social revolution, the greatest hindrance to the birth of a society based on equality and liberty, as well as the historic means designed to prevent this blossoming. The latter work to abolish the State and not to reform it.

That is what we have done, and still do, with other species. They're effectively things; they're property that we can own, buy and sell. We use them as is convenient and we keep them in ways that suit us best, producing products we want at the cheapest prices. So my argument is simply that this is wrong, this is not justifiable if we want to defend the idea of human equality against those who have a narrower definition. I don't think we can say that somehow we, as humans, are the sole repository of all moral value, and that all beings beyond our species don't matter. I think they do matter, and we need to expand our moral consideration to take that into account.

If a being suffers there can be no moral justification for refusing to take that suffering into consideration. No matter what the nature of the being, the principle of equality requires that its suffering be counted equally with the like suffering - insofar as rough comparisons can be made - of any other being. So the limit of sentience is the only defensible boundary of concern for the interests of others. To mark this boundary by some other characteristic like intelligence or rationality would be to mark it in an arbitrary manner. Why not choose some other characteristic, like skin color?

Racists violate the principle of equality by giving greater weight to the interests of members of their own race when there is a clash between their interests and the interests of those of another race. Sexists violate the principle of equality by favoring the interests of their own sex. Similarly, speciesists allow the interests of their own species to override the greater interests of members of other species. The pattern is identical in each case.

Increasingly, politics is not about "who gets what, when, how" but about values, each of them considered to be absolute. Politics is about "the right to life"...It is about the environment. It is about gaining equality for groups alleged to be oppressed...None of these issues is economic. All are fundamentally moral.
The over curious are not over wise. The sum of all that makes a just man happy consists in the well choosing of his wife: and there, well to discharge it, does require equality of years, of birth, of fortune; for beauty being poor, and not cried up by birth or wealth, can truly mix with neither. And wealth, when there's such difference in years, and fair descent, must make the yoke uneasy.
Thus, communism violates the sovereignty of the conscience, and equality: the first, by restricting spontaneity of mind and heart, and freedom of thought and action; the second, by placing labor and laziness, skill and stupidity, and even vice and virtue on an equality in point of comfort. For the rest, if property is impossible on account of the desire to accumulate, communism would soon become so through the desire to shirk.
